BOOKING
After you are arrested for a DUI, you will be booked at a police facility.
At this time the authorites will take your photograph and record your fingerprints. They will also get any basic information from you, such as your birth date and address.
If the situation calls for it, you may be asked to provide a handwriting sample or even participate in a line-up. Ideally you will have a chance to contact an attorney after you have supplied your information, and before you agree to take part in a line-up.
In the case that you are detained by the police but not booked within a reasonable period of time (normally several hours, or overnight) your lawyer may go to a judge and obtain a writ of habeas corpus. A writ of habeas corpus is an order issued by the court instructing the police to bring you before the court so that a judge may decide whether or not you are being lawfully held by the authorities.
