DETERMINING SENTENCES

A judge is provided a few basic guidelines for sentencing, as every crime has a sanction attached to it. However, within that prescribed punishment there is normally a range of severity, and perhaps minimum and maximum penalties.


A statute for a misdemeanor crime may say an offender must pay up to $1000 in fines and serve up to 6 months in jail, or both; it is up to the logic and common sense of the judge to decide on the most fitting penalty.
