FIELD SOBRIETY TESTS

The officer may direct you to complete a series of tests known as Field Sobriety Tests. FST’s are supposed to determine if you are intoxicated or not, however the results of these tests are highly subjective.


First and foremost, field sobriety tests are voluntary.


Note that the officer will rarely tell you this, and will probably use your refusal against you. Nevertheless, the tests themselves are a lose-lose situation for those taking them. FST's can be difficult for even a completely sober person to pass, not to mention if you have had a drink or two.


The results of these tests can only be used to make a case against you, and rarely, if ever, provide the officer with a reason to let you go.


The National Highway Traffic Safety Association furthermore has quite specific guidelines on how these tests can be administered, and if not done so properly a capable DUI attorney can prove that they are inadmissible in court.
