IGNITION INTERLOCK DEVICE

The ignition interlock device is a small breathalyzer that is installed in an automobile, directly linked to the ignition, making the driver blow an acceptable Blood Alcohol Content level in order for the automobile to start.

Every 15 minutes the device will prompt the driver to blow again, and failure to do so (or if your BAC has risen) will cause the car to stop. This is done in an attempt to ensure that a sober person does not blow into the device for a drunk driver, which is of course illegal.

Judges are progressively turning to these devices to help curb drunk driving, and you do not have to be a repeat offender for a judge to order its installation. Judges are given discretion in ordering these devices for first time offenders, but are normally required to order their installation for repeat offenders, high BAC levels, and DUI with minors in the vehicle.

Note that ignition interlock devices are installed at the offender’s expense. Normally there is an installation fee, and a monthly rental fee.

Furthermore, IID's record all the data it collects. Breath test results, number of starts and stops, any tampering, etc. is all available for later review.

Although ignition interlock devices are a step in the right direction towards curbing drunk driving, they have their problems. False positives (due to a substance like mouthwash) and device malfunctions are common; indeed, IID's share many of the same deficiencies as breathalyzers used by officers in the field to determine BAC level.

Any good Seattle DUI attorney will use all means at his or her disposal to avoid jail time and harsh penalties for their client. If a defendant is willing to install an ignition interlock device, sometimes a Seattle DUI attorney can use that fact to compromise and negotiate a lighter sentence with the prosecutor.
